Workers’ Compensation Attorney in Albany, GA

How Workers’ Comp Settlements Work in Georgia

A workers’ compensation settlement is not a bonus or a reward. It is a trade. You give up your right to future weekly checks and often your future medical care in exchange for a negotiated payment.

Whether that trade is fair depends on the numbers the insurance company already knows, and most injured workers have never seen.

At Underwood Law, we ensure that injured workers across Georgia fully understand what they are giving up before signing, and we work hard to ensure that the price is fair.

    What You’re Actually Negotiating

What Does a Georgia Workers’ Comp Settlement Pay For?

Every settlement must be approved by the State Board of Workers’ Compensation under O.C.G.A. § 34-9-15. Once approved, it generally closes your claim for good. That’s why it helps to think of a settlement as buying out specific benefits you would otherwise continue to receive.

Depending on how the settlement is written, it may include:

    • Future weekly checks: Temporary total disability payments of two-thirds of your salary, up to $800 per week, for most injuries occurring on or after July 1, 2023, for a maximum of 400 weeks in non-catastrophic cases.
    • Permanent impairment benefits: Payments based on your permanent partial disability rating.
    • Future medical care: Coverage for doctor visits, surgery, therapy, and prescription medications that the insurer would normally pay for.
    • Disputed issues: Risk of a judge ruling against you or the insurer.

Most Georgia settlements are paid in a single lump sum. In larger cases, especially those involving Medicare, some of the money may be paid over time through a structured arrangement. In either case, the agreement should specify exactly which benefits are closed and which, if any, remain open, so there will be no surprises when the next doctor’s bill arrives.

Representation at Every Stage of Your Claim

When Settlement Comes Up for Albany, Southwest, and South Central Georgia Workers

Settlement isn’t right for every case, and no one can force you to accept an offer. Here are some situations where it often makes sense to consider talking numbers.
    You’ve Reached MMI

Once your doctor says you have reached maximum medical improvement and assigns an impairment rating, your claim has a clear value. Settling before that point usually means guessing about your future.

    The Claim Is Disputed

If the insurer denies that your injury was work-related, a settlement could put money into your hands without having to wait months for a hearing. The trade-off is a smaller amount in exchange for certainty.

    You’re Ready to Move On

Some workers want to change careers, relocate, or simply stop dealing with adjusters. A lump sum can fund retraining or a fresh start, but only if it’s large enough to last.

    Light-Duty Disputes

When an employer offers a job that doesn’t fit your requirements, benefits can be suspended. These situations often create pressure to settle, and it is at this point that careful advice is most important.

Your Benefit Weeks Are Running Out

Non-catastrophic claims have a 400-week limit on income and medical benefits. As this limit gets closer, the insurance company’s view of your claim changes, as does your leverage.

A Family Has Lost a Loved One

Fatal-injury claims can also be settled. Our guide to Georgia workers’ compensation death benefits explains what dependents are owed before any offer is considered.

    Before You Say Yes

Critical Steps to Take Before Accepting an Offer

An offer can feel like a relief after months of uncertainty. Take these steps before signing anything.

    Know Your Numbers

Add up the weekly benefits you have left, your impairment rating, and the cost of care your doctor expects. That’s the baseline against which any offer should be measured.

    Price Your Future Care

Surgery, injections, and prescriptions cost real money years from now. If the medical center closes at settlement, you will be paying for everything yourself.

    Read the Fine Print

Many agreements include a resignation from your job and the release of other claims. Know what you are giving up in addition to benefits.

    Contact an Attorney

To help protect your rights, contact a workers’ compensation attorney for guidance as soon as possible. We recommend the great team at Underwood Law.

Why Do You Need a Workers’ Compensation Attorney in Georgia?

    Don’t Do It Alone

Many injured workers assume filing a claim is straightforward—report the injury, see a doctor, and receive benefits. In reality, it’s rarely that simple.

    Insurance companies often:

    • Dispute the severity of injuries
    • Push employees back to work too soon
    • Deny valid claims outright
    • Offer settlements far below what workers deserve

Having an experienced workers’ compensation attorney can make the difference between a denied claim and full financial recovery.

At Underwood Law, we’ve spent over a decade helping injured workers in Albany and across Southwest Georgia navigate these challenges and secure the benefits they need.

    Settlement Timing in Georgia

When Can You Settle, and How Long Does It Take?

There’s no single deadline to settle, but several factors affect your options and your leverage.

Here are the key timelines for your claim:

    • You must file your claim with the board within one year of the incident (or longer if your employer paid for medical treatment or weekly benefits). If you don’t file within this time, your claim may never reach a settlement.
    • If your benefits stop and you have not reached a settlement, you generally have two years from the last week you received benefits to seek more.
    • Non-catastrophic claims are limited to 400 weeks of income and medical benefits.
    • The board usually reviews a signed agreement within a few days to a couple of weeks. After approval, the insurance company must pay within 20 days, or they will face a penalty.
