Personal Injury Attorney Serving Southwest and South Central Georgia Communities

Holding Powerful Companies Accountable Across Southwest & South Central Georgia

You took the medication prescribed by your doctor. You sprayed weed killer sold at a farm supply store. You trusted a medical device implanted to help you heal. Then, there was a diagnosis that no one had warned you about.

When a dangerous product harms thousands of people, companies behind it rarely admit fault. They have deep pockets and large legal teams and the patience to wait for injured people. Mass tort litigation gives individuals a way to stand together without losing their own voice.

At Underwood Law, we help people in Albany and Southwest Georgia to understand their rights and seek accountability when defective products, medications, or hazardous substances cause serious harm.

Strength in Numbers, Your Claim Stays Yours

What Is a Mass Tort Claim?

A mass tort is a civil claim where many people have been harmed by the same product, drug or substance. This is often confused with class action, but there is an important difference. In class action, one suit represents everyone and the outcome is shared. In mass torts, each person has an individual claim filed. Your injuries, medical history and losses are evaluated separately.

Many of these cases are grouped in federal courts through multidistrict litigation (MDL). The Judicial Panel on Multidistrict Litigation sends similar cases to one judge, who manages shared pre-trial work so that the same evidence is not fought over thousands of times.

    What this means for you:

    • Your case is filed under your name and is not combined with other cases.
    • Expert testimony and document discovery are shared among several cases.
    • Early “bellwether” trials provide insight into how jurors respond to evidence.
    • Settlement offers, when offered, are typically based on the specific facts of your injury.
    • Your case can continue to move forward even if the court overseeing it is located in another state.

Is Your Injury Part of a Larger Pattern?

Signs You May Have a Mass Tort Claim in Georgia

Many people never connect their illness to a product until they hear about others with the same diagnosis. These signs suggest that your situation may deserve closer attention.
A Serious Diagnosis After Using a Product

You developed cancer, organ damage, a neurological condition, or another serious illness after regularly using medication, medical devices, or chemical products.

A Recall or New Safety Warning

The product has been recalled, removed from shelves, or issued a new or stronger warning since it was used. Consumer product recalls are listed by the Consumer Product Safety Commission.

    Others With the Same Injury

News reports, support groups, or your own doctor may mention other people who have used the same product and have developed similar health problems.

    Long-Term Use or Exposure

You have used the product for months or years, or you have been exposed to a substance repeatedly through your job, your home, or your community.

    Warnings That Came Too Late

The label never mentions the risks you face. Georgia’s product liability statute allows claims against manufacturers who fail to warn of known dangers.

What to Do If You Suspect a Dangerous Product Harmed You

Critical Steps to Protect Your Health and Your Claim

Mass tort cases are based on records. The steps you take now can make it much easier to show what you used, when you used it, and how it affected you.

    Seek Immediate Medical Care

Your health should always come first. Even if your injuries don’t seem severe initially, prompt medical treatment is critical. Some injuries worsen over time, and medical records help establish a clear connection between the accident and your injuries.

    Report the Incident

Whether the injury occurred during a truck accident, on unsafe property, or under another circumstance, reporting the incident creates an official record that may later support your claim. Police reports, incident reports, and witness statements can become important evidence.

    Preserve Evidence

Photographs, videos, damaged property, and witness information can all help strengthen your case. If possible, document the scene, visible injuries, hazardous conditions, and anything else relevant to the incident before evidence disappears.

Avoid Speaking to Insurance Adjusters Alone

Insurance companies often attempt to obtain statements that can later be used against you. Before accepting a settlement offer or giving a recorded statement, consider speaking with an attorney who can protect your interests.

    Stay Off Social Media

Posting photos, updates, or comments about your accident or injuries can hurt your case. Insurance companies may review your accounts and attempt to use your posts to dispute the seriousness of your injuries.

    Contact an Experienced Injury Attorney

Early legal guidance can make a major difference in the outcome of your claim. An attorney can preserve evidence, handle communications with insurers, and help position your case for maximum compensation.

Why Do You Need a Personal Injury Attorney in Georgia?

Protect Your Rights from the Start

Insurance companies aren’t focused on what’s best for you. Their goal is often to settle claims quickly and for as little money as possible. Without experienced legal representation, you may recover far less than your case is truly worth.

At Underwood Law, we understand how life changing serious injuries can be. For more than a decade, we’ve helped injury victims throughout Albany and Southwest Georgia pursue justice and financial recovery after devastating accidents.

Your personal injury attorney can help:

    • Investigate the incident immediately
    • Preserve critical evidence before it disappears
    • Identify all potentially liable parties
    • Calculate both current and future damages
    • Push back against insurance company tactics
    • Negotiate aggressively for fair compensation
    • Prepare your case for trial if necessary
    Mass Tort Deadlines in Georgia

How Long Do You Have to File a Claim?

Deadlines are one of the most common ways in which valid mass tort claims are lost. In Georgia, there are two types of time limits that are relevant, and they operate in different ways.

    • Statute of limitations: Under O.C.G.A. § 9-3-33, most personal injury claims must be filed within two years. For illnesses that develop slowly, the clock may begin when you discover, or should reasonably have discovered, the injury and its connection to the product.
    • Statute of Repose: Under O.C.G.A. § 51-1-11, many product liability claims are barred ten years after the product’s first sale, even if your injury occurred later.
    • Repose exceptions: The same statute carves out claims for failure to warn and certain negligence, including those involving products that cause disease or birth defects and conduct showing reckless disregard for life.
    • Wrongful Death: Families generally have two years to bring a claim. Learn more about it on our wrongful death page.
    • Settlement program deadlines: Once a settlement is announced, claimants may face separate registration dates.
