If you are owed a weekly workers’ compensation check in Georgia, you rely on that check for support. Georgia law knows how true this is, so there are strict deadlines on when you receive your payments. If your workers’ comp check is late, repeatedly delayed, or missing, you might be owed a 15% penalty which gets added to your payment.

At Underwood Law, LLC, our Georgia workers’ compensation attorneys are here to help. If you’ve been dealing with late or missing payments, let us help you fix the problem and get the 15% penalty you’re owed.

Georgia’s Deadline for Weekly Workers’ Comp Checks

Georgia workers’ comp law requires that benefits be paid on time every single week. You already accomplished a workers’ compensation settlement or claim, now you deserve to have it arrive when it is supposed to.

A workers’ comp check is considered late if it is not delivered within seven days after the date it was due. This applies to Temporary Total Disability (TTD), Temporary Partial Disability (TPD), and Permanent Partial Disability (PPD) payments. The penalty kicks in even if the payment is only one day late.

Your Right to a 15% Penalty for Late Payments

Georgia law requires insurers to add a 15% penalty to any late workers’ comp check. This penalty is not discretionary. It is not something you have to “prove” or negotiate. It is automatic

The penalty is designed to discourage insurers from delaying payments and to compensate injured workers for the disruption caused by late checks.

Common Reasons Workers’ Comp Checks Arrive Late

Insurers rarely admit fault, but late payments often happen because of:

  • Processing delays or staffing shortages
  • Internal approval bottlenecks
  • Mailing issues or address errors
  • Bank or electronic transfer problems
  • Miscommunication between adjusters and claims departments
  • Failure to update your benefit status after a doctor’s appointment

None of these excuses eliminate the penalty. Georgia law focuses on timeliness, not the insurer’s reasons.

What to Do When Your Georgia Workers’ Comp Check Is Late

If your check doesn’t arrive on time, take these steps immediately:

  1. Document the Delay: Write down the date the check was due and the date it actually arrived. Keep envelopes, postmarks, and bank deposit confirmations.
  2. Notify the Adjuster in Writing: Email is best. Politely state that the payment was late and that Georgia law requires a 15% penalty. Written notice creates a record.
  3. Request the Penalty Directly: Ask the insurer to issue the penalty payment promptly. Some adjusters will add it without argument once you cite the statute.
  4. Track Repeated Delays: If late payments become a pattern, this may indicate a larger compliance issue. Repeated delays often justify filing a claim with the State Board.
  5. Contact a Workers’ Comp Attorney if the Insurer Refuses to Pay: Georgia attorneys can file a motion or request a hearing to enforce the penalty. In many cases, the insurer pays once a lawyer gets involved.

Late Payments Can Signal Bigger Problems

A late check is sometimes just a clerical mistake, but it can also be a warning sign that the insurer is preparing to:

  • Suspend benefits
  • Challenge your work restrictions
  • Push for an independent medical exam (IME)
  • Claim you missed an appointment
  • Reduce your benefit amount

If your payments suddenly become inconsistent, it’s smart to review your claim status and make sure the insurer isn’t quietly building a case to cut off benefits.

What If Your Check Never Arrives?

A missing check is treated the same as a late check and the 15% penalty still applies. But a missing payment may also indicate:

  • A suspension notice you never received
  • A change in your mailing address
  • An internal error
  • A dispute over your disability status
  • A failure to process your doctor’s work‑status report

If a check is missing entirely, contact the adjuster immediately and request confirmation of your benefit status in writing.
